Rules
for the carriage of passengers and baggage by buses and the procedure for ticket sales
1. General provisions.
1.1. These Rules regulate the procedure for the carriage of passengers and baggage by buses, the procedure for the sale of Vilartrans tickets (hereinafter referred to as the Carrier), and also define the rights, obligations and responsibilities of the Carrier and Passengers.
1.2. These Rules have been drawn up on the basis of the Rules for the Provision of Passenger Road Transport Services (Resolution of the Cabinet of Ministers of Ukraine No. 176 dated 18.02.1997, as amended and supplemented). If certain clauses of these Rules and Resolution No. 176 differ, Resolution No. 176 shall prevail, while the other clauses shall remain valid.
1.3. With regard to transportation on international routes, these Rules have been drawn up on the basis of the Rules for Crossing the State Border by Citizens of Ukraine (Resolution of the Cabinet of Ministers of Ukraine No. 57 dated 22.01.1995, as amended and supplemented), and international treaties of Ukraine (reference information on the list of documents required for foreigners to cross the border of Ukraine is available at https://dpsu.gov.ua/ua/Dokumenti-dlya-peretinannya-derzhavnogo-kordonu-Ukraini).
1.4. In the event of amendments to these Rules, for tickets purchased before such amendments enter into force, the rules that were valid on the date of ticket purchase shall remain in force.
2. Travel documents and documents required for boarding.
2.1. A ticket is a travel document with a price determined by the Carrier, the issuance of which confirms the conclusion of a carriage agreement between the Carrier and the Passenger and gives the Passenger the right to use the trip exclusively on the basis of the data specified in the ticket, namely: surname and first name, route, date, time and place of departure.
2.2. The purchase of a ticket confirms that the Passenger has read and agrees to these Rules and the Carrier’s Privacy Policy.
2.3. The ticket is also a contract of compulsory personal accident insurance for passengers on transport under the conditions defined by Resolution of the Cabinet of Ministers of Ukraine No. 959 dated 14.08.1996, as amended and supplemented.
2.4. The following types of tickets are accepted by the Carrier for carriage:
2.4.1. the Carrier’s electronic ticket;
2.4.2. electronic tickets of partner agencies (Busfor, Infobus, PrivatBank and others);
2.4.3. a ticket issued through bus station ticket offices;
2.4.4. a ticket issued at the Carrier’s offices;
2.4.5. a ticket issued by the dispatcher during boarding of the bus.
2.5. The ticket may be presented in printed form, in PDF format, on the screen of a phone and/or tablet. For international routes, the ticket must be in printed form and must not contain errors in the Passenger’s data.
2.6. After one of the above-mentioned types of tickets is presented, the responsible persons of the Carrier verify it against the ticket and boarding documentation.
2.7. If none of the above-mentioned types of tickets is presented, the Carrier has the right to terminate the carriage agreement unilaterally.
2.8. The documents confirming the Passenger’s right to travel within Ukraine are the ticket and an identity document, including its electronic version in the “Diia” mobile application.
2.9. The documents confirming the Passenger’s right to travel on international routes are: a ticket and a valid travel document.
2.10. Valid travel documents are documents that allow the Passenger to cross internal European and external state borders of Ukraine, the validity period of which has not expired or will not expire during the upcoming trip (taking into account the permitted number of days of stay or the validity period of the visa). Such documents may include:
2.10.1. a passport or ID card of a citizen of an EU country for entry into and/or travel through the territory of EU countries, Schengen countries or other countries, if the domestic legislation of the country does not require the Passenger to have other travel documents, and if required, an international passport and/or other travel documents;
2.10.2. a passport and a visa affixed to such passport — for entry into and/or transit through the territory of a country subject to a visa regime established by that country’s legislation, and a migration card;
2.10.3. a child’s passport, a child’s travel document or a visa affixed to such passport — for entry into and/or travel through or stay in the territory of a country subject to a visa regime established by that country’s legislation; when travelling with children, additional travel documents may be required, namely: birth certificate, notarized authorization from parents, divorce certificate, court decision, etc. — the list of such documents depends on the legislation of the country from which or into which the child is travelling;
2.10.4. a diplomatic passport, service passport or visa, if this is required by the legislation of the country of destination or transit countries;
2.10.5. for citizens of Ukraine: a biometric international passport (containing a chip symbol on the front and identification pages of the passport), an international passport with a visa affixed to such passport; for the information of citizens of Ukraine, additional documents for crossing the state border may include (the Passenger must ensure their availability depending on the purpose of the trip): an insurance policy covering medical expenses for travelling abroad, an invitation, a return ticket or hotel reservation, etc.;
2.10.6. other documents that may be required in accordance with changes in the legislation of the countries of destination or transit countries.
2.11. Documents required for crossing state borders, entry and exit, and transit through the territory of EU countries are the Passenger’s personal documents; therefore, responsibility before the relevant state authorities of the countries of destination for their availability, proper execution, completeness, validity period, etc. rests directly with the Passenger. Responsibility for children’s travel documents rests with the parents or persons accompanying them.
2.12. The Passenger is obliged to keep the ticket until the end of the trip and present it upon request of the Carrier’s control service, drivers, dispatchers and persons responsible for boarding.
2.13. Travelling on the Carrier’s buses without a ticket is strictly prohibited; if a passenger without a ticket is found during the route, a ticket must be issued by the employee responsible for boarding at the nearest stop (subject to availability of a free seat).
2.14. If a passenger without a ticket is found occupying the seat of a passenger who has one of the types of tickets accepted by the Carrier, priority in transportation shall be given to the passenger with a ticket.
2.15. For accounting purposes, the Carrier’s electronic ticket may be stamped at the Carrier’s office where it was purchased; if the ticket was purchased through the Carrier’s website, the stamp may be placed at the Carrier’s central office.
3. Boarding/disembarkation, route, stops, border crossing.
3.1. The Passenger is recommended to arrive at the bus boarding point specified in the ticket no later than 15 minutes before the scheduled departure time.
3.2. The Carrier’s crew does not personally inform Passengers who have not appeared for boarding before the departure time specified in the ticket.
3.3. Boarding is carried out only at the place indicated as the place of departure in the ticket.
3.4. In force majeure circumstances, the boarding place may be changed, of which the Carrier or the dispatchers responsible for boarding shall notify the Passenger in advance before the departure of the bus.
3.5. Boarding is carried out according to the seats selected by the Passengers in accordance with the presented ticket. The Carrier has the right to change the seat number selected by the Passenger.
3.6. If the seat is not specified in the ticket (when purchasing tickets through certain bus station ticket offices or certain partner agencies), boarding is carried out on available seats allocated for such bus station and/or partner agency, with the information entered into the ticket and boarding documentation.
3.7. Only persons over 14 years of age are allowed to sit in seats numbered 1, 2, 3, 4. Passengers in these seats must fasten their seat belts if the design of the buses provides for them.
3.8. Children under 14 years of age are transported only with the consent of parents (adoptive parents), guardians and when accompanied by authorized persons. The Carrier does not provide services for accompanying minors. Children aged 14 and over are allowed to travel without adult accompaniment.
3.9. The Carrier has the right to refuse boarding if the crew and dispatchers responsible for passenger boarding may have doubts regarding the correctness of ticket issuance, the validity of travel documents, or if these documents may cause problems with border services when crossing state borders or delay the route at the border.
3.10. If the Passenger is not allowed to continue the trip at the transfer point to an international route (on the Carrier’s route with a transfer), at the state border during its crossing, the carriage agreement shall be deemed fulfilled, despite the fact that the transportation was performed to a different extent than that provided for by the ticket, the trip cost shall not be refunded (except where the passenger has time to return the ticket for the second part of the trip with penalties and the execution of relevant documents), and claims shall not be considered by the Carrier.
3.11. If the Passenger is detained at the state border for verification of travel documents, individual inspection, customs procedures regarding their personal belongings, baggage, Tax Free refund, the carriage agreement shall be deemed fulfilled, despite the fact that the transportation was performed to a different extent than that provided for by the ticket, the bus has the right to continue the route without the Passenger, their personal belongings and baggage, the trip cost shall not be refunded, and claims shall not be considered by the Carrier.
3.12. The bus driver and dispatchers responsible for boarding have the right not to allow Passengers to travel who:
3.12.1. do not have tickets or do not present an established certificate confirming the right to fare benefits;
3.12.2. are under the influence of alcohol or drugs;
3.12.3. violate public order;
3.12.4. carry dangerous goods, in particular flammable, explosive goods and goods that may soil the bus or passengers’ clothing.
3.13. In the event of replacement of the bus with a bus of another capacity, another cabin configuration or comfort class, the decision on seating Passengers shall be made by the dispatchers responsible for boarding or the driver, and this shall be recorded in the ticket and boarding documentation.
3.14. Information about the route, schedule, stops and boarding/disembarkation points may additionally be obtained by the Passenger on the website, at the contact center and by calling the central office.
3.15. The bus makes stops along the route in accordance with the schedule, taking into account force majeure circumstances that may arise along the route and which the Carrier’s driver cannot influence (weather conditions, traffic jams, detours, actions of state control authorities, queues at state borders, road traffic accidents involving the bus and its unpredictable technical malfunction).
3.16. The duration of stops along the route (including sanitary stops) is announced by the driver.
3.17. After the crew announces a stop, the Passenger is obliged to return to the bus cabin before the end of the announced time. If the Passenger does not return to the bus cabin within 5 (five) minutes after the end of the specified time, the driver has the right to continue the trip without the Passenger, and the late Passenger continues the trip independently; in this case, the trip cost shall not be refunded and claims shall not be considered by the Carrier.
3.18. The arrival time indicated in the ticket is approximate, taking into account force majeure circumstances that may arise along the route and which the Carrier’s driver cannot influence (weather conditions, traffic jams, detours, actions of state control authorities, queues at state borders, road traffic accidents involving the bus and its unpredictable technical malfunction).
3.19. The Carrier does not guarantee and is not responsible for the late arrival of buses at transfer points, transfers to other types of transport and other carriers, or connections between routes, except for transfers provided for by the Carrier’s own tickets.
3.20. If the Passenger does not make a guaranteed transfer provided for by the Carrier’s tickets, the Carrier shall provide the Passenger with an alternative bus and/or an alternative option for delivery to the destination. If the Passenger refuses to use the alternative bus and/or alternative delivery option, the Carrier shall refund the Passenger the full cost of the unused second part of the trip.
3.21. When calculating the arrival time at Boryspil Airport and selecting connections with the Carrier’s bus routes, the Passenger should take into account that at least 2 hours before the departure time specified in the boarding pass are required for timely completion of all airport formalities. Due to the lack of infrastructure near Terminal “F” of Boryspil Airport for the entry of the Carrier’s buses, the route schedule provides boarding and disembarkation only near Terminal “D” of Boryspil Airport. The schedule of buses between terminals can be found on the airport website.
3.22. Boarding and disembarkation of passengers is carried out in accordance with the Carrier’s permits. Boarding and disembarkation in other places is prohibited. The Passenger is obliged to board the bus at the departure point specified in the ticket.
3.23. The route schedule does not provide for disembarkation of passengers within populated areas in violation of the Traffic Rules.
3.24. If the delay in the departure of the route for any reason from the departure point or arrival at the destination specified in the ticket is more than 2 hours from the planned schedule, the Passenger may use the trip with the changed schedule or initiate a refund for the unused part of the trip. If the Passenger uses the trip with the changed schedule, further claims shall not be considered by the Carrier.
4. Purchase, refund and changes to tickets, travel conditions, cancellations and delays of routes.
4.1. Tickets are available for purchase 90 days before the Passenger’s departure date.
4.2. Tickets for the Carrier’s bus routes may be purchased through the following sales channels:
4.2.1. the Carrier’s website;
4.2.2. partner agency websites;
4.2.3. the Carrier’s offices;
4.2.4. bus station ticket offices;
4.2.5. in certain cases, directly on the bus with mandatory issuance of a ticket by the dispatcher.
4.3. The Carrier does not make advance reservations of tickets through any sales channel.
4.4. A ticket is generated for one Passenger for one trip; when issuing a ticket with transfers on the Carrier’s routes, two tickets are generated (but with one bank transaction).
4.5. When issuing a ticket through the Carrier’s website and/or office, and through partner agency websites, current data must be provided: surname, first name, phone number and email address. Failure to provide current Passenger data releases the Carrier from responsibility for untimely notification of a route delay or cancellation.
4.6. The purchase of a ticket by the Passenger confirms consent to the processing of personal data (surname, first name, phone number and email address); the ticket may not be transferred to a third party.
4.7. In the surname and first name in tickets for routes within Ukraine, up to 3 errors are allowed if this does not result in a complete change of the surname and first name.
4.8. Errors in tickets for international routes cannot be corrected after the ticket has been purchased; if the Passenger independently discovers an error before the start of the route, it is necessary to return the ticket and purchase a new one, specifying the correct data.
4.9. After purchasing tickets through any of the Carrier’s sales channels, the Passenger is obliged to independently check the correctness of the specified data; the Carrier is not responsible for inaccuracies that do not correspond to the purpose of the trip (including, but not limited to: inaccuracies in the date, month, departure time, etc.) and were discovered during boarding of the Passenger for the route.
4.10. Responsibility for the correctness of information in tickets sold through partner agency websites and the compliance of this information with the actual transportation conditions of the Carrier rests with the partners within the framework of contractual agency relations.
4.11. The Passenger may, on their own initiative, refuse the trip or, in the event of route cancellation by the Carrier, independently return the ticket as follows:
4.11.1. at the Carrier’s offices where the ticket refund function is available (the list of such offices can be found by the Passenger on the website, by calling the contact center or by calling the central office) upon presentation of the original ticket and an identity document;
4.11.2. at the agency that is the Carrier’s partner where the ticket was purchased, by contacting the online support of the partner’s website;
4.11.3. tickets purchased at bus stations or bus terminals are returned only at those bus stations or bus terminals where they were purchased.
4.12. In the event of voluntary return by the Passenger of a ticket purchased on the Carrier’s website, in mobile applications or at the Carrier’s offices, the ticket price is refunded partially (without refunding the advance ticket sales fee in the amount of 10% of the fare, but not less than 30.00 (thirty) hryvnias):
4.12.1. more than one day before bus departure — 100% of the ticket price;
4.12.2. more than 2 hours before bus departure — 90% of the ticket price;
4.12.3. more than 1 hour before bus departure — 80% of the ticket price;
4.12.4. less than 1 hour before departure, ticket cancellation is impossible;
4.12.5. if the passenger is late at the specified time for the bus departure point indicated in the ticket, this ticket is considered cancelled and its cost is not refundable;
4.12.6. in the event of route cancellation by the Carrier, the passenger is refunded the full ticket price (without deduction of advance ticket sales fees);
4.12.7. if the passenger agrees to change the date and/or time specified in the purchased ticket(s) to another departure time or date, if the route was cancelled by the Carrier, the rescheduled tickets are returned on the general grounds defined in clauses 4.12.1 - 4.12.5.
4.13. Compensation for a ticket purchased on the Carrier’s website (in accordance with the refund conditions) is returned to the card from which the payment was made within 14 banking days.
4.14. When purchasing tickets at bus station ticket offices and through partner agency websites, the ticket refund request is submitted and the cost (part of the cost) is refunded exclusively through the bus stations and partner agencies in accordance with their own rules for ticket sale and refund.
4.15. For tickets purchased under promotions, with discounts, granted on preferential and other terms, special rules and restrictions may apply, of which the Passenger is informed additionally.
4.16. Refunds for duplicate tickets are not possible.
4.17. If the Passenger refuses the trip for any reason from the moment of ticket purchase on the website, in mobile applications or at the Carrier’s office, the Passenger shall be paid the ticket price minus the advance ticket sales fee. The advance ticket sales fee is 10 percent of the fare, but not less than 30.00 (thirty) hryvnias if the fare is less than 300.00 (three hundred) hryvnias.
4.18. The basic level of passenger transportation services is the safe delivery of the Passenger with an assigned seat by the Carrier’s bus from the departure point to the destination specified in the ticket, and if baggage has been checked in by the Passenger — delivery of the baggage to the destination and its handover to the Passenger.
4.19. During the route, the Carrier may provide additional services, the availability or absence of which depends on the direction, duration of the route and modification of the Carrier’s buses: air conditioning, Wi-Fi, USB sockets, individual built-in multimedia screen (without headphones), video content, still water, etc.
4.20. In the event of the Carrier’s refusal to provide the transportation service (including, but not limited to cancellation or cancellation of the route), except in force majeure cases, the Passenger has the right to a refund for the purchased ticket equal to its full cost, including but not limited to the following cases:
4.21.1. route cancellation;
4.21.2. cancellation of the route during the journey due to a technical malfunction of the bus and the Carrier’s inability to provide an alternative bus and/or alternative option for delivery to the destination;
4.21.3. failure to provide the Passenger with the seat specified in the ticket due to a technical failure in the ticket sales system and possible double sale of one seat, and if the Passenger refuses another seat offered by the Carrier.
4.22. If a bus of a lower class than that specified in the route schedule or on the Carrier’s ticket purchase website is provided for transportation, a partial refund of the ticket price may be possible upon the Passenger’s request, namely the refund of the difference in fare between the comfort classes of buses on routes determined by the Carrier.
4.23. In the event of illness or accident confirmed by relevant documents, the ticket price shall be refunded within 3 days after bus departure or a ticket for another Carrier route shall be issued free of charge.
4.24. During the quarantine period due to the spread of COVID-19, if the Passenger has a body temperature above 37.2°C and signs of acute respiratory viral infection at the time of boarding the bus, they shall not be admitted for transportation; the refund of the ticket price shall be made on the basis of clauses 4.12 and 4.18 of these Rules.
5. Baggage and hand luggage.
5.1. Baggage means the Passenger’s personal belongings that they take with them on the trip and that are properly packed in bags and/or travel suitcases. All other items except a baby stroller, wheelchair, bicycle and sports equipment are considered cargo. Cargo is not allowed for transportation by the Carrier’s buses; for its transportation, the Passenger may contact the Carrier’s cargo offices, the list and working hours of which can be found on the website and by calling the contact center.
5.2. On the Carrier’s domestic and international routes, the Passenger is allowed to carry baggage free of charge in the bus luggage compartment and hand luggage in the bus cabin on the luggage rack, the number of items, dimensions and weight of which are determined by the Carrier.
5.3. Under standard conditions, the Carrier allows the following to be transported free of charge:
5.3.1. baggage in the amount of 1 item, measuring 80 50 30 cm, weighing up to 20 kg inclusive;
5.3.2. hand luggage in the amount of 1 item, measuring 42 30 18 cm, weighing up to 7 kg inclusive.
5.4. Additional baggage is accepted for transportation only if there is free space in the bus luggage compartment and for an additional fee. Passengers must contact the Carrier’s offices and bus station ticket offices in advance in order to notify about the transportation of excess baggage or baggage whose total dimensions exceed the permitted dimensions for transportation.
5.5. Additional baggage in the amount of 1 item, packed in a bag or travel suitcase, must not exceed the dimensions and weight of baggage permitted for free transportation, namely: measuring 80 50 30 cm and weighing up to 20 kg inclusive.
5.6. A fee is charged for the transportation of additional baggage according to the tariffs determined by the Carrier.
5.7. The Carrier has the right to refuse the Passenger transportation of additional baggage.
5.8. If the number, dimensions and weight of baggage and hand luggage in these Rules differ from those specified in the ticket, the ticket shall prevail.
5.9. The Passenger is responsible for the safety of hand luggage in the bus cabin; hand luggage may not be placed in the bus aisle.
5.10. Special baggage on domestic and international routes in the form of a baby stroller, wheelchair, bicycle and sports equipment may be accepted for transportation subject to prior notification of the Carrier and/or bus station and its proper packaging.
5.11. A baby stroller and wheelchair are accepted for transportation free of charge; a fee is charged for the transportation of bicycles and sports equipment according to the tariffs determined by the Carrier.
5.12. A baby stroller and wheelchair are accepted for transportation only in folded form; if a Passenger with musculoskeletal disabilities needs crutches for movement, they may be taken into the bus cabin.
5.13. Special baggage may not exceed 240 cm in total dimensions and may not exceed 30 kg in weight.
5.14. The transportation of musical instruments exceeding the dimensions of hand luggage is carried out only in a hard case, provided that the Passenger purchases an additional seat on the bus; musical instruments may not be checked into the bus luggage compartment and the Carrier is not responsible for their safety.
6. Rights and obligations of the Passenger and the Carrier.
6.1. The bus Passenger has the right:
6.1.1. to safe and high-quality transportation;
6.1.2. to make claims against the Carrier regarding the Carrier’s fulfilment of the terms of the carriage agreement;
6.1.3. to purchase a ticket with a fixed date, place and departure time and to refuse the trip with a ticket refund under the conditions provided for by these Rules;
6.1.4. to transport free of charge one item of baggage and one item of hand luggage according to the dimensions and weight defined by these Rules;
6.1.5. to transport with them free of charge one child under the age of 3 without the right for the child to occupy a separate seat;
6.1.6. to receive information from the Carrier, driver or bus station employee about transportation services.
6.2. The Carrier has the right:
6.2.1. to cancel bus routes in the event of circumstances that it could not foresee and the occurrence of which it could not prevent, with a refund to Passengers of the funds paid by them for transportation;
6.2.2. to change the bus class and the Passenger’s seat;
6.2.3. to restrict or terminate transportation in the event of a natural disaster, epidemic, epizootic or other emergency situation;
6.2.4. to stop the movement of vehicles in the event of a threat to the life and health of Passengers;
6.2.5. to refuse transportation to the Passenger under the conditions defined by these Rules;
6.2.6. not to accept for transportation baggage and items restricted for transportation under the conditions defined by these Rules;
6.2.7. to indicate in the baggage receipt the condition of baggage that has external damage, or to refuse its transportation if the Passenger objects to the relevant note being made;
6.2.8. to provide passengers with benefits for payment of transportation services;
6.2.9. to offer passengers additional services;
6.2.10. during the quarantine period due to the spread of COVID-19, the Carrier has the right to refuse transportation to the Passenger if the Passenger has a body temperature above 37.2°C and signs of acute respiratory viral infection;
6.2.11. due to the spread of COVID-19, to require the passenger to remain in the bus cabin wearing a mask or respirator throughout the entire journey;
6.2.12. in the event of a worsening epidemiological situation in the regions to which transportation is carried out, to change seat numbers and passenger seating at its own discretion in order to maintain social distance.
6.3. The bus Passenger is obliged:
6.3.1. before purchasing a ticket, to read these Rules, transportation tariffs, accurately determine the date and time of the trip, and ensure the availability of valid travel documents;
6.3.2. after purchasing a ticket, to check the correctness of the specified data, and if errors are detected, to initiate changes;
6.3.3. to have with them a travel ticket, baggage receipt, and if entitled to discounted travel — the relevant certificate or document on the basis of which the benefit is granted, and in the event of the introduction of an automated fare payment accounting system — to register the electronic ticket;
6.3.4. to occupy the seat specified in the ticket, keep the ticket until the end of the trip and present it in unfolded form upon request of persons authorized to carry out control;
6.3.5. to board and disembark only after the bus has come to a complete stop;
6.3.6. to pay for the transportation of baggage and hand luggage in accordance with the requirements of these Rules;
6.3.7. during international bus transportation, to have properly executed documents required for entry into the country of destination or transit countries and to present them to the Carrier upon request;
6.3.8. to inform the driver about found forgotten items, documents and valuables;
6.3.9. the Passenger is obliged to load and unload their own baggage independently in accordance with the recommendations of the bus driver; the Driver has the right, in exceptional cases, to assist the Passenger in loading and unloading baggage, which does not give the Passenger the right to demand such assistance, except in cases where such assistance is needed by a Passenger with disabilities, a pregnant woman or a child;
6.3.10. due to the spread of COVID-19, at the time of boarding the bus and throughout the entire journey, to wear a mask or respirator;
6.3.11. to comply with the requirements of these Rules.
6.4. The Carrier is obliged:
6.4.1. to take measures to ensure the safe travel of Passengers and delivery of baggage in accordance with the carriage agreement and the route schedule;
6.4.2. to provide Passengers with accurate and timely information about the names of stops, possible transfers, fare amount, etc.;
6.4.3. before the start of international passenger bus transportation, to check that Passengers have the documents required for entry into the country of destination or transit countries and to refuse international transportation to Passengers who have not presented the required documents;
6.4.4. to comply with the requirements of these Rules, the Licensing Conditions for carrying out business activities for the carriage of Passengers by road transport, the Traffic Rules and the rules of technical operation of vehicles.
7. Liability, procedure for consideration of claims.
7.1. The Passenger bears individual responsibility for improper execution of travel documents granting the right to cross the state borders of the countries along the route and transit countries.
7.2. The Passenger is obliged to compensate the Carrier for losses incurred due to the Passenger’s arrival at the state border of the country of destination or transit country on the Carrier’s bus operating an international route without a valid travel document granting the right to enter the country of destination or transit country.
7.3. The Passenger bears individual responsibility for violating the laws of the countries along the route and transit countries.
7.4. The Passenger bears material responsibility for damage caused to the Carrier’s bus and/or its equipment and is obliged to compensate the Carrier for it.
7.5. In the event of intentional soiling of the bus, the Passenger bears material responsibility and compensates the Carrier for the costs of its cleaning according to the current tariffs of the cleaning companies servicing the Carrier.
7.6. The Carrier’s responsibility for the life and health of the Passenger and their baggage is determined by the legislation of Ukraine. In the event of the occurrence of risks provided for by Resolution of the Cabinet of Ministers of Ukraine No. 959 dated 14.08.1996, the Passenger (or their heirs) may apply to the insurer indicated in the ticket for payment of insurance compensation. The insured amount is paid regardless of payments under state social insurance, social security and compensation for losses.
7.7. The Carrier is responsible only for baggage that was duly accepted for transportation, that is, for which a baggage receipt was issued to the Passenger.
7.8. When baggage is transported in the bus luggage compartment, the Carrier is responsible only for the presence of the checked baggage item, but is not responsible for its safety and integrity, natural wear and tear occurring during the movement of the bus (scratches, etc.).
7.9. The Carrier is not responsible for the safety and integrity of hand luggage carried by the Passenger on the bus luggage rack, or for documents and valuable items that may be inside it.
7.10. The Carrier is not responsible for damage to items that are not allowed for transportation in the bus luggage compartment, as well as for documents, valuable, glass, fragile, improperly packed items, products that spoil quickly and require special temperature conditions for transportation and are carried by the Passenger in the bus luggage compartment.
7.11. The Carrier is not responsible for personal belongings left by the Passenger in the bus cabin. If forgotten items are found, the Passenger may contact the Carrier, and if the Carrier finds the Passenger’s forgotten items, the Carrier draws up the relevant documents and transfers them for storage to its own office at the initial or final point of the route.
7.12. The Carrier is not responsible for any losses incurred by the Passenger due to deviation from the schedule, or for any unsuccessful transfers to other types of transport or other carriers due to deviation from the schedule.
7.13. Failure to provide current Passenger data releases the Carrier from responsibility for untimely notification of route delay or cancellation.
7.14. The Carrier is not responsible for possible errors made by the Passenger when issuing tickets.
7.15. When transferring to the Carrier’s routes, the Passenger is responsible for moving their baggage to the bus on which they will continue the trip.
7.16. Passengers’ complaints and claims regarding the trip (with all supporting documents) must be submitted to the Carrier within 30 days after the trip; claims received after this period shall not be considered.
7.17. Complaints and claims from partner agencies regarding the Passenger’s trip are accepted within the time limits defined by the relevant agency agreements.
7.18. If it is established that the Passenger has committed actions provided for in clause 9.1 of these Rules, the Carrier has the right:
- to refuse to provide transportation services to the Passenger without refunding the ticket price if the Passenger’s actions take place before the bus departs;
- to refuse to provide transportation services to the Passenger without refunding the ticket price and to disembark the Passenger at the nearest public transport stop in the nearest populated area.
8. Transportation restrictions.
8.1. Passengers are prohibited from:
8.1.1. distracting the driver from driving the bus while it is moving;
8.1.2. opening the vehicle doors independently before it has come to a complete stop;
8.1.3. preventing the doors from closing;
8.1.4. placing hand luggage in places where it obstructs the free movement of passengers along the cabin;
8.1.5. travelling without paying the fare or without presenting an established identity certificate (if entitled to fare benefits);
8.1.6. making corrections to the ticket and transferring it to another person;
8.1.7. carrying baggage and hand luggage on a seat (except in cases provided for in clause 5.14);
8.1.8. using emergency equipment without necessity;
8.1.9. disturbing public order;
8.1.10. using elements of the bus cabin for purposes other than their intended purpose;
8.1.11. smoking in the bus cabin and service areas, consuming alcoholic beverages or narcotic substances;
8.1.12. carrying animals and birds, pets in the bus cabin, except for guide dogs accompanying persons with disabilities;
8.1.13. animals may be transported only in the bus luggage compartment, provided that the animal is supplied with a special cage, food, water and hygiene products;
8.1.14. transportation is carried out on condition that the passenger assumes full responsibility for the animal;
8.1.15. carrying any weapon in the bus cabin. The Passenger has the right to transport weapons exclusively with valid permits and exclusively in the luggage compartment;
8.1.16. moving around the bus cabin while the bus is moving without necessity;
8.1.17. placing feet on the folding table and seats, blocking the aisle in the bus, lying on the bus floor;
8.1.18. interfering with the work of the crew or causing inconvenience to other passengers by their behavior.
